Judge Shaul Shohat had to deal with a quite unusual case

Judge Shaul Shohat hdeal with a quite unusual casead to deal with an unusual case. He had to decide for the divorced spouse who will get the right to take care of a cat named Jane Eyre and a dog named Sheina.

Also the judge had to clarify the question about how exactly someone should consider animals - as a part of the property or as a living beings. The blind cat and the dog have been picked up from the street by the spouse few years ago, when nobody was thinking of a divorce.

But two years ago the couple divorced and now a man wanted to have a right for the custodianship over his pets. However, no matter how great was his desire to continue communication with the animals, in the lawsuit both: a cat and dog were mentioned as a part of joint property.

The judge decided that as long as in a modern legal system, animals are "legal persons", then the decision should be based on their interests. The court decided that a woman had shown enough of her love and devotion to the animals.

In addition, a change of residence could be harmful to the blind cat. And a desire of a man to take care of the animals was traced not so much by his love for pets, but by his desire to be close to his ex-wife. On the basis of this arguments the man's claim was rejected.
